Welcome to the RSP USA, Inc. (“RSP”, “us” “we” or “our”) website (the “Site”). Please read these Terms
and Conditions (the “Terms”) carefully, because they govern your access to and use of the Site and the
products (the “Products” or “Product”), and the content (the “Content”) and the services (the “Services”
or “Service”) therein. The Site is available for your use only on the condition that you agree to the Terms

You are solely responsible for the content and context of all items and materials you compose or otherwise distribute in using the Services. You warrant and agree that, while accessing the Site or any Content and during or as a result of using any Service, you shall not:
harass, threaten, embarrass, or cause distress or discomfort upon another party; transmit or otherwise distribute any information, data, text, files, links, software, messages, communications, or other materials that may be considered unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially, ethnically, or otherwise objectionable; impersonate any other person or entity or misrepresent your affiliation with any other person or entity;

upload, publish, transmit, reproduce, or distribute in any way information, software, or other material that is protected by copyright or other intellectual property rights, without first obtaining proper permission; and

You agree that the party receiving that information can rely upon and use such information in any manner. You acknowledge and agree that you are solely responsible for the accuracy and content of all information provided by you.

Modification of Materials Used
Due to worldwide supply shortages, we reserve the right to replace current paper stock for our printed products with a reasonable alternative and without advanced notice. This is to ensure that your marketing remains consistent and reaches your prospects without delay.

Order Processing and Delivery
The estimated time for processing and delivery of your order to the USPS is two business days. As a result, no additional changes can be made to the design or mail list once your order is placed. RSP USA does not assume liability for customer-generated errors in content, margins/bleeds, or typos. In addition, printed colors may not match perfectly to what you see on your monitor or printer due to variations in computer and print technology.
Once mailed, please allow up to 5 business days for delivery of first-class mail and up to 15 business days for standard mail. Delivery times may fluctuate during holidays or peak mail periods. By placing your order, you agree that delivery to USPS fulfills our delivery obligation, and you waive any right to dispute credit card charges related to failed delivery of your order by the USPS.

Certain products we provide have the option of showing our Home Value Estimate Map (the “HVE Map” or “HVE Maps”), which directs the user to MyHomeEst.com for an estimated home value. The estimate provided to homeowners via MyHomeEst.com is an unbiased estimated valuation produced by multiple data vendors. Each data vendor utilizes a complex and proprietary data algorithm to produce its estimate, which can vary among the vendors depending on the data available. RSP combines and analyzes these estimates to generate an overall best estimate of the home. In most cases, RSP's valuations are in line with other major estimate sites. However, RSP makes no guarantees regarding the accuracy of the estimates due to varying information available.

Target Farming Reports
Target Farming Reports (the “Reports” or “Report”) will be mailed a minimum of six (6) times to a minimum of 300 households every 30 or 60 days. At least 85% of all qualified homeowners must be mailed. The criteria that determine qualification: homeowner must be neither a business, trust, or LLC, and must not own multiple properties.
The monthly fee ($39) begins once you lock in your farm areas by selecting your areas and agreeing to the Terms & Conditions. The monthly fee keeps your Farm exclusive to you, meaning no other RSP client may mail Reports there. This exclusivity applies only to Reports and not to any of RSP's other products. The fee also fuels your campaign with local home sales data, our Smart Targeted Mailing List and Home Value Estimate map, featured listings and comps, and personalized service.
Reports are $1.14 each and mailed via the United States Postage Service. The price includes Standard Class postage, labor and materials. Reports may be mailed with First-Class postage for an additional 10¢ each. The price per Report may change based on available volume discounts: quantity 501-1,000 (2¢ off), quantity 1,001-5,000 (4¢ off), quantity 5,000+ (6¢ off). A print processing fee of $3.95 will be charged with each Report mailing. Reports are paid for at the time they are prepared for your review/approval. You have up to 60 days from the time you reserve your Farm to get your Reports printed and mailed or be subject to release of your exclusive Farm areas. The price per Report may rise based on postal increases by U.S.P.S. as implemented. Any other price changes will be made with a 14- day notice.
RSP's Cancellation Policy for Target Farming Reports requires that you mail at least six (6) times during your enrollment. If you cancel your enrollment prior to your third (3rd) Report mailing, you will be subject to a $300 Report setup fee and a $300 cancellation fee. If you decide to cancel your enrollment after completing your third (3rd) mailing and before your sixth (6th) mailing, you will be charged a $300 cancellation fee. Requests to cancel must be submitted in writing 30 days in advance of your next Report mailing. After you have completed six (6) mailings, you may continue with Target Farming Reports on a month-by-month basis with no Agreement, Report setup fees or cancellation fees. RSP has the right to terminate this Agreement and your enrollment at any time.

It is a FREE SERVICE for custom Just Listed/Sold Postcards to be prepared and emailed to you for review/approval within days of your transaction. If you approve the postcard, it will be mailed to target homeowners using the mailing list you select/edit. Postcards are Jumbo size, (8.5" x 5.5") and printed full color on both sides of heavy cardstock. The following options are also available at a different cost: Panoramic size, Standard/Small size, First-Class postage. Speak with your representative for details. The price per postcard may change based on available volume discounts: quantity 501-1,000 (2¢ off), quantity 1,001-5,000 (4¢ off), quantity 5,000+ (6¢ off). A print processing fee of $3.95 will be charged with each postcard mailing. A discount of 5¢ off each postcard is applied if you are also enrolled in and mailing Target Farm Reports. Market research has shown that hot leads are four times more likely to list their home in the next 90 days than the average homeowner. These hot leads are produced when homeowners visit MyHomeEst.com with a unique personal URL they obtain from postcards and/or Target Farming Reports mailed from the agent.
The first business day after the homeowner visits these sites, agents who have activated Fast Track will have a series of postcards mailed over multiple weeks to each lead on the agent's behalf. The series is comprised of 3 to 8 cards pre-selected by the agent. One postcard is sent out via First-Class mail each week. Agents are charged the cost of the series at the time the first postcard is mailed. For each hot lead, agents have the option of cancelling their Fast Track Follow-Up Campaign before the first card is mailed. This option is available in the lead notification emails sent at the time each homeowner visits MyHomeEst.com. Agents can also cancel after the first postcard is mailed by visiting the Lead section in their account at rspusa.com.
Agents who activate the Fast Track service have an Easy-Pay Wallet that is used to cover the cost of the campaigns. The agent's credit card on file is charged whenever the Easy-Pay Wallet needs to be replenished. For example, when the very first Fast Track postcard is mailed, the credit card on file is charged $25. This money is used to mail all subsequent Fast Track postcards. Once the Easy-Pay Wallet is exhausted, it is automatically replenished with another $25 the next time another hot lead is generated. If in the agent cancels the Fast Track service, any balance remaining in the Easy-Pay Wallet is promptly refunded. Agents who gain a large number of hot leads every month (produced through homeowner visits to MyHomeEst.com), the amount charged to their credit card to fund their Easy-Pay Wallet will be higher than the default $25 amount in order to average one charge to their credit card per month. A receipt is emailed to the agent whenever their credit card is charged to replenish their Easy-Pay Wallet.

Refund Policy
No refunds on monthly fees or charges associated with the branding, production, printing and/or mailing of materials will be issued for any reason. No refunds will be issued for social media campaigns resulting in minimal (or no) leads.

Financial Considerations
You understand and agree that all fees and costs related to your use of the Products, the Site, and other materials/services provided will be charged to your credit card provided to us and that you agree to maintain in a current and valid status. If you are a team, with costs split between team members, and one member fails to make payment when due, the remaining member(s) will be billed. You will have the ability to change credit cards by notifying RSP in writing immediately after the change.

The failure by RSP to exercise or enforce any rights or provisions of the Terms shall not constitute a waiver of such right or provision. You agree that any cause of action arising out of, or related to, the Site, the Content, or any Services must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. The Terms will be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of laws, all matters arising hereunder shall be exclusively venued in Manatee County, Florida, and you agree to the exclusive jurisdiction of the state and federal courts located in Manatee County, Florida.
